Yukon Government to Review Court Decision in Paulsen Case
WHITEHORSE - The following statement was released today by Premier Dennis Fentie regarding the decision of the Yukon Court of Appeal in the case involving the duty to consult in connection with the disposition of a parcel of farmland within the Traditional Territory of the Little Salmon/Carmacks First Nation.
"The appeal was allowed and the Court confirmed that the processes followed by the Government of Yukon met the standard of consultation required by the law," Fentie said.
"The Government of Yukon has, and will continue to follow, appropriate processes of consultation with the First Nations and with other members of the community in connection with dispositions of Yukon Crown Land."
The government will be reviewing the decision carefully with respect to the interpretation of the Final Agreement, the circumstances under which consultation will be required in the future, and the standard of consultation to be met, Fentie added.
