Government of Yukon seeks court’s opinion on water use licence

WHITEHORSE—The Government of Yukon is appealing a recent decision by the Yukon Water Board under the Yukon Waters Act and requesting a judicial review of the decision under the Placer Mining Act. The decision is on the water use licence issued to Northern Exposures Inc. for a placer project on the Indian River.

The Yukon government is seeking the court’s review to help guide interpretations of the application of subsection 83(2) and section 86 of the Yukon Environmental and Socio-economic Assessment Act (YESAA). These sections set out the rules establishing the relationship between authorizations such as water use licences and placer land use approvals and decision documents issued through the YESAA process.
